Your privacy is very important to us. This Privacy Policy (“Policy”) describes how we collect, use, communicate and disclose and make use of your personal information through your interactions with us both online and offline. College Raptor collects a variety of information in order to provide the highest quality service to our users. We want you to understand what information we gather from or about you, how we use it, and the safeguards we have in place to protect it. This Policy applies to College Raptor, Shoppingsheet.com, Raptorfi.com, and all other College Raptor websites and applications that link to this Policy (the “Services”). As you review this Policy, please keep the following in mind:

  • We use the term “personal information” to describe information that can be associated with you and can be used to identify you. Personal information does not include information that does not identify a specific person or that is publicly available.
  • If you have a financial product or service for personal, family or household purposes, we will use and share any information that we collect from or about you in accordance with our Consumer Privacy Notice which offers you certain choices with respect to the use and sharing of your information. Please note that the Consumer Privacy Notice is not applicable to information provided by users of a Net Price Calculator viewable from a licensee institution’s web site. Institutions license the Net Price Calculator from College Raptor, and neither creditworthiness information nor other non-public personal information submitted on a licensee institution’s Net Price Calculator is shared by College Raptor with affiliates or non-affiliates except for the licensee institution itself.
  • By accessing, using or submitting information to the Services, you agree to this Policy and our Terms of Service and all of its dispute resolution provisions, including arbitration, limitation on damages and choice of law.
  • If you are a California resident, you may have rights under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”). Please see our CCPA Policy and Notice below.

PERSONAL INFORMATION WE COLLECT

The categories of personal information that College Raptor has collected in the preceding 12 months may include:

  • Contact Information, including your name, postal address, email address, and telephone number
  • Demographic Information, including your race, gender, age
  • Education Information, including your GPA, degrees held and years of schooling
  • Financial Information
  • Internet, device or electronic network activity information such as your browsing and search history, browser type, and interactions with websites and advertisements
  • Analytics about your use of our Services, including scrolling, mouse clicks and keystrokes

We may also collect information that you provide to us about other people, including, but not limited to, their names, postal addresses, telephone numbers, mobile numbers, and email addresses for purposes of fulfilling the purposes for which you provide such information.

SOURCES OF PERSONAL INFORMATION

During the 12-month period prior to the effective date of this Policy, we may have obtained personal information about you from the following sources:

  • Information Provided by You. We collect information provided by you when you (1) inquire about or obtain our Services; (2) communicate with us or request information from us, whether via email or other means; (3) fill out forms or fields on the Services; (4) register for an account; (5) sign-up for any of our newsletters; (6) provide feedback or participate in online surveys or questionnaires; (7) input information into our interactive programming features; and (8) participate in any of our marketing initiatives, including contests, scholarship offers, events, or promotions.
  • Information from Other Sources. We may collect information about you from other services that we may provide, our affiliates, third-party or public sources (such as from public forums, social networks, and blogs), other users of the Services, and our business partners.
  • Automatic Information Collection. We and our service providers use automatic data collection technologies to collect and store usage information. We also may allow third-party advertising companies and ad networks to use automatic data collection technologies to collect Usage Information for purposes of providing interest-based ads.

USES OF PERSONAL INFORMATION

We use your personal information for the following business purposes:

  • Provide you the Services requested
  • Provide customer support, including responding to your requests and questions and troubleshooting and resolving problems or complaints
  • Communicate with you, including to respond to your requests, feedback, and inquiries
  • Develop and display products, services, and content tailored to your interests on the Services and other online properties

College Raptor may also use and share anonymized, de-identified or aggregated information for analysis to understand more about our customers and our industry, or for other commercial purposes permitted by law. This information is not personal information.

DISCLOSURES OF PERSONAL INFORMATION

During the 12-month period prior to the effective date of this Policy, we may have disclosed your personal information with the following parties:

  • Affiliates and Subsidiaries. We may disclose your personal information with any College Raptor business or our affiliated companies (i.e., companies that control, are controlled by, or are under common control with us).
  • Service Providers. We may disclose with our service providers and vendors to enable them to assist us in providing you the products or services you request through the Services or to provide us with support for our internal and business operations, such as data processing, data storage, research, analytics, web hosting, marketing, and delivery of promotional or transactional materials.
  • Non-Affiliated Partner Companies. With your consent, we may disclose with other non- affiliated companies, parties, or organizations when you engage in certain activities through the Services or services that are sponsored or provided by them, including, but not limited to purchasing products or services offered by these third parties, electing to receive information or communications from them, or electing to participate in contests, sweepstakes, games, scholarships, or other programs sponsored or provided by these third parties, in whole or in part. Also with your consent, we may disclose your personal information with companies that are interested in contacting you or providing offers to you that may be related to our Services or about other products or services you may find interesting.
  • Advertising Networks and Marketing Companies. Some of our Services have features such as, plugins, widgets, or other tools made available by third parties that may result in information being collected or disclosed between us and the third party. You may have the right to opt out of our use of these technologies, as further described in this Policy.
  • With Other Parties at Your Direction or Request. For example, through www.collegeraptor.com, we disclose your name and contact information with schools, to which you request us to introduce you, and through any refer-a-friend or email-a-friend function offered on the Services, we may disclose your name and email address with any person to whom you request that we disclose such information.
  • Governmental Authorities. As required by law or legal process, we may disclose your personal information with federal or state regulatory agencies, law enforcement, courts, and other governmental authorities or when we believe that disclosure is necessary to detect, prevent or report suspicious activities, prevent physical harm, financial loss or violations of our agreements and policies.
  • Parties Involved with Business Transfers. We may disclose your personal information to third parties in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution, or liquidation).
  • Collaborators and Professional Advisors. We may disclose your personal information with our professional advisors, such as auditors and law firms, as well as other financial institutions and entities with whom we jointly develop or offer, endorse or sponsor financial products or services.

In each case when we disclose your information to non-service provider third parties, your information will become subject to the information use and sharing practices of such third parties, and such third parties will not be restricted by this Policy with respect to their use and further sharing of your information.

AUTOMATIC INFORMATION COLLECTION TECHNOLOGIES AND USAGE INFORMATION

Cookies are small text files that are placed on your computer to distinguish you from other visitors to our Services. The use of cookies helps us to improve your experience on our website by providing data on which of our Service’s features are popular. The use of cookies is a standard practice. We or our third-party advertising service providers may place cookies or similar files on your hard drive. Without these essential cookies, the Services will not perform as smoothly for you as we would like them to and we may not be able to provide the Services or certain services or features you request. Analytics Cookies Analytics cookies allow us to understand more about how many visitors we have to our Services, record how they interact with our Services, how many times they visit us, and how many times a user viewed specific pages within our Services. Although analytics cookies allow us to gather specific information about the pages that you visit and whether you have visited our Services multiple times, we cannot use them to find out details such as your name or address. We use Google Analytics and session replay technology. Advertising Cookies College Raptor may work with third-party online or mobile network advertisers that use cookies to help us manage advertising and measure its effectiveness. These cookies enable third-party ad networks to recognize a unique cookie on your computer or mobile device and may be placed by us or our network advertising firm that works with our third-party network advertiser. The information that is collected and shared by cookies may be linked to the device identifier of the device you are using to allow us to keep track of all the sites and mobile applications you have visited that are associated with the ad network. This information may be used for the purpose of targeting advertisements on the College Raptor Services and third-party sites or mobile applications based on those interests.

Commercially Recognized Opt-Out Signals (Global Privacy Controls)

We will endeavor to recognize commercially recognized opt out signals (e.g., Global Privacy Controls). Recognition of this signal will only take place with respect to the device and/or browser that communicates the signal.

THIRD-PARTY CONTENT

The Services and all electronic communications sent in connection with the Services, may contain links, videos, images, or other content provided by third parties. We do not necessarily endorse these websites, products, services, or practices. We do not control, and are not responsible for, the privacy and security practices of these third parties. We recommend that you review the privacy and security policies of these third parties to determine how they handle information they may collect from or about you.

The Services may also allow you to engage with social media features, such as the Facebook Like button, YouTube, and Twitter widgets, when you are logged into those services. These features may collect information about your IP address and which page you are visiting on the Services, and they may set a cookie to make sure the feature functions properly. Your interactions with these features and the information from or about you collected by them are governed by the privacy policies of the companies that provide them.

CALIFORNIA CONSUMER PRIVACY ACT NOTICE

This California Consumer Privacy Act Notice explains how College Raptor collects, uses, and discloses personal information relating to California residents covered by the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”). This “Notice” constitutes our notice at collection and our privacy policy pursuant to the CCPA. If you are a Job Applicant, please refer to the Job Applicant Data Privacy Policy. If you are an employee, contractor, or intern, please refer to the Employment Data Privacy Policy.

Under the CCPA, “personal information” is information that identifies, relates to, or could be reasonably linked with a particular California resident. Please note, however, that the CCPA does not apply to information that is subject to certain financial regulations, such as the Gramm Leach Bliley Act (“GLBA”) and the Fair Credit Reporting Act (“FCRA”). For example, if you are a California resident and you have an online account with us for a personal product or service, the CCPA rights do not apply to the personal information associated with that account. Our Collection, Use, and Disclosure of Personal Information

The categories of personal information, sources, disclosures, and purposes for which we collect, use, and disclose personal information are set out in the following sections above: “Personal Information We Collect,” “Sources of Personal Information,” “Uses of Personal Information,” and “Disclosures of Personal Information.” Please note that we only collect sensitive personal information when you provide us the information and we use that information only to provide you the Services or as otherwise permitted by applicable law. At this time, the only sensitive personal information we may collect is racial or ethnic origin information.

Retention of Personal Information

The length of time that we intend to retain each category of personal information will depend on a number of criteria, including (i) the length of time we are required to retain personal information in order to comply with applicable legal and regulatory requirements, (ii) the length of time we may need to retain personal information in order to accomplish the business or commercial purpose(s) for which such personal information is collected, used or disclosed (as indicated in this Policy), and (iii) whether you choose to exercise your right, subject to certain exceptions, to request deletion of your personal information.

Selling and Sharing of CA Personal Information.

As described above in the “Disclosures of Your Personal Information” section, we may share the following categories of personal information with third parties who are considered “third parties” as defined under California law since we disclose personal information to them which they may use for cross context behavioral advertising. Our disclosure of personal information to the third parties who use the information for these purposes may constitute a “sharing” of personal information as defined under California law.

In the 12 months prior to the Effective date of this Notice, we shared for cross context behavioral advertising and may continue to share, the following categories of personal information:

  • Identifiers, such as contact information; and
  • Internet or network activity information, such as browsing history and interactions with our website.

The categories of third parties to which we may share (as defined by California law) the above-described categories of personal information include online Advertising Networks and Marketing Companies.

Rights under the CCPA

If you are a California resident covered by the CCPA, you have the following rights:

  • Right to Know and Access. To request a disclosure of the categories of personal information that have been collected; the categories of sources from which the information was collected; the business or commercial purpose for collecting, selling, or sharing the personal information; the categories of third parties to whom the business discloses personal information; and access to the specific pieces of personal information College Raptor has collected about you in a portable format.
  • Right to Request Deletion of Personal Information. To request that College Raptor delete personal information that we have collected from you, subject to certain exceptions provided under the CCPA. Please note that we cannot delete your personal information except by also deleting your user account. Once your user account is deleted, it cannot be recovered.
  • Right To Correct Inaccurate Personal Information. To request that College Raptor correct any inaccurate personal information that it maintains about you.
  • Right to Opt-Out of the Sale or Sharing of Personal Information for Cross-Context Behavioral Advertising. Our use of cookies or other tracking technologies for cross-contextual advertising purposes is deemed a “sale” or “share” under the CCPA of personal information. As such, you can opt out of our use of tracking technologies and cookies by clicking the “Do Not Sell or Share My Personal Information” button at the bottom of the website.
  • Right of No Retaliation Following Opt-Out or Exercise of Other Rights. We do not discriminate against individuals who exercise any of their rights described in this Policy, nor do we retaliate against individuals who exercise these rights.
  • Automated Processing. Under certain circumstances, you have the right to object to a significant decision based solely on automated processing (i.e., without human intervention) unless that decision is required or authorized by law.
  • Right to Limit of our Use and Disclosure of your Sensitive Personal Information (in certain instances and if permissible under applicable law). We do not use or disclose sensitive personal information for purposes other than those which cannot be limited under applicable law

Please note that many of the above rights are subject to exceptions and limitations. Your rights and our responses will vary based on the circumstances of the request. If you choose to assert any of these rights under applicable law or regulation, we will respond within the time period prescribed by such law or regulation. In some cases, we may limit or deny your requests to access or delete your information. This may occur because the law permits or requires us to do so, or if we are unable to adequately verify your identity.

ADDITIONAL CHOICES ABOUT USE AND DISCLOSURE OF YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide to us. Below are some mechanisms that provide you with control over your information:

Promotional Emails. If you do not wish to receive promotional emails from us, including our e- newsletters, contact us at [email protected] to opt-out or follow the unsubscribe process at the bottom of the promotional email. Note that even if you opt-out, you may still receive transactional emails from us (e.g., emails related to the completion of your registration, correction of user data, password reset requests, reminder emails that you have requested, and any other similar communications essential to your transactions on or made through the Services).

SECURITY

We strive to use reasonable security measures to protect your information collected through the Services. However, no method of transmission or electronic storage is 100% effective, and we cannot guarantee absolute security. Therefore, your use of the Services is at your own risk and we do not promise or guarantee, and you should not expect, that your information will always and absolutely remain private and secure. We are not responsible for the circumvention of any privacy settings or security measures contained on or concerning the Services. You are also responsible for taking reasonable steps to protect your personal information against unauthorized disclosure or misuse.

CHILDREN’S PRIVACY

The Services are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are under the age of 13 do not use or provide any information with respect to the Services.

In the event that we learn that we have collected personal information from a child younger than 13 years old, we will delete that information and terminate the child's account (if any). If you believe that a child under the age of 13 has provided us with personal information without verification of parental consent, please contact us at [email protected].

TRANSFERS OF INFORMATION TO OTHER COUNTRIES

The Services are operated in the United States and are not intended for international users. This Policy is intended to cover the collection of information on the Services from residents of the United States. If you are accessing the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States and other countries and territories. The information protection laws of the United States and the other countries and territories might not be as comprehensive or protective as those in your country. By using the Services, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy. We make no claim that the Services may be lawfully viewed or used outside of the United States.

CHANGES TO THIS POLICY

We may update or amend this Policy at any time. This Policy will reflect the date it was last updated or amended.
